TERMS AND CONDITIONS
Article 1 – General
1.1. Any order implies de facto unreserved acceptance of these general conditions.
1.2. These general conditions exclude all other general conditions, and in particular the general conditions of the buyer. These general conditions govern the entire contractual relationship between Bowtex and the buyer.
1.3. The buyer expressly renounces to avail himself of his own general conditions, even if these provide for an exclusion clause from all other general conditions.
Article 2 – Contract
2.1. The contract is only concluded after express acceptance of the order by Bowtex. The receipt of an order by Bowtex does not imply de facto acceptance of said order.
2.2. Bowtex reserves the right to refuse orders without having to justify itself as to the reasons for this refusal.
Article 3 – Delivery times
3.1. The delivery times that Bowtex communicates to the buyer are purely indicative and do not constitute any commitment by Bowtex.
3.2. Any delivery delays do not give rise to any compensation from Bowtex. The buyer expressly waives the right to claim damages from Bowtex due to late delivery.
3.3. Any delivery delays do not allow the customer to cancel orders, unless expressly agreed in writing by Bowtex.
Article 4 – Price
4.1. Unless otherwise stipulated, all prices are expressed in euros, including VAT.
4.2. Unless otherwise stipulated, invoices issued by Bowtex are payable on the due date.
4.3. Invoices not paid when due fall automatically and without prior notice, interest calculated at the rate of 8% per year.
4.4. Invoices not paid when due will be automatically increased, and without prior notice, by a lump sum penalty clause of 10% of the total amount including VAT of unpaid invoices, with a minimum of 25.00 euros.
4.5. In the event of non-payment of an invoice on its due date, all other invoices become immediately due and ipso jure. Bowtex reserves the right to make new deliveries only if the previous invoices have been paid in full.
Article 5 – Modifications
Any changes in the transport tariff and any new taxes whatsoever occurring after conclusion of the contract give rise, as of right and without prior warning, to a corresponding increase in the agreed prices.
Article 6 – Transfer of risks and transfer of property
6.1. The transfer of risks for the goods to the buyer takes place from transport. In the event of damage to the goods during transport, it is the purchaser’s responsibility to file any recourse that they wish to exercise against the carrier.
6.2. The transfer of ownership to the buyer takes place at the time of full payment of the price.
Article 7 – Guarantee
In accordance with the requirements of the law of September 1, 2004 relating to the protection of consumers in the event of the sale of consumer goods, Bowtex guarantees the purchaser of any lack of conformity which would exist when the goods were delivered and which would appear within a period of two years from this date.Article 8 – Limitation of liability
8.1. The products sold by Bowtex have been designed with the utmost care and attention. However, the use of these products does not exempt the user from putting on the equipment required by law. Products sold by Bowtex do not guarantee user safety in the event of a fall or accident of any kind. Bowtex is not responsible for any damage resulting from a fall or accident, of any kind whatsoever, incurred by the user of the products sold by it.
8.2. Any complaint relating to an apparent defect must be reported to Bowtex, by registered mail, within 1 month of receipt of the goods, and before any transformation.
8.3. Any complaint relating to a hidden defect must be reported to Bowtex, by registered mail, within 1 month of the discovery of the defect.
8.4. The lodging of a complaint does not exempt the purchaser from paying the price invoiced on the due date of the invoice.
8.5. Bowtex’s liability is strictly limited to the replacement of defective goods or the reimbursement of the invoice price. The buyer expressly waives the right to claim any additional compensation from Bowtex of any kind.
Article 9 – Right of withdrawal
9.1. The buyer has the right to notify the company that he renounces the purchase, without penalties and without giving any reason, within 14 calendar days from the day after the day of delivery of the goods.
9.2. The buyer cannot exercise his right of withdrawal if the product and / or its packaging are no longer in their original condition.
9.3. The buyer must exercise his right of withdrawal within the prescribed time, in writing to [email protected]
9.4. The product must be returned by the buyer within 14 calendar days, from the day after the day of delivery of the product, in its condition and in its original packaging, with any additional documentation possibly attached to the product (warranty, manual of use, etc.). 9.5. Shipping, exchanges and refunds
The shipping fee is automatically calculated at checkout.
Return and exchange requests must be made in writing to Bowtex customer service team at [email protected]. For customers located within the European Union, return costs are due by Bowtex. For customers located outside of the European Union, return costs are at the customer's charge with the exception of the United States.
Article 10 – Force majeure
10.1. Any cause of force majeure or unpredictability, including cases of force majeure or unpredictability simply alleged by the suppliers of Bowtex, justify Bowtex to suspend, in whole or in part, its deliveries.
10.2. Bowtex is entitled to terminate the contract if the state of force majeure or unforeseen circumstances lasts more than 2 months. To do this, Bowtex must denounce the contract in writing, at the address indicated by the buyer in the order.
10.3. Force majeure or unforeseen circumstances are, without this list being exhaustive, slowing down or interruption of production, cases of mobilization, strikes, wars, riots, lockouts, restrictions administrative, in particular on import or export, delay in transport, machine breakdown, etc.
Article 11 – Intellectual property
Bowtex is the owner of all intellectual property rights relating to the products sold. The name “Bowtex” is the subject of a Community trade mark.
Article 12 – Interdependence
The cancellation or invalidity of one of the articles of the general conditions does not affect the other articles or the validity of the general conditions as a whole.
Article 13 – Competent courts, applicable law
13.1. Only the courts of Brussels, sitting in French, are competent to hear any dispute.
13.2. For disputes which are within the jurisdiction of the justice of the peace, only the justice of the peace of the canton of Forest, sitting in French, is competent.
13.3. The law applicable to any dispute is Belgian law.
