Article 1 – General Provisions

1.1. Any order automatically implies unconditional acceptance of these general terms and conditions.

1.2. These general terms and conditions exclude all other general conditions, including the buyer’s general conditions. These terms govern the entirety of the contractual relationship between Bowtex and the buyer.

1.3. The buyer expressly waives the right to invoke their own general terms and conditions, even if those include a clause excluding other general terms.

Article 2 – Contract

2.1. The contract is only concluded after Bowtex has expressly accepted the order. Receipt of an order by Bowtex does not imply acceptance of the said order.

2.2. Bowtex reserves the right to refuse orders without having to justify the reasons for such refusal.

Article 3 – Delivery Times

3.1. Delivery times communicated by Bowtex are purely indicative and do not constitute any binding commitment from Bowtex.

3.2. Any delays in delivery do not entitle the buyer to any compensation from Bowtex. The buyer expressly waives the right to claim damages from Bowtex for delivery delays.

3.3. Delivery delays can in no case justify the cancellation of orders by the buyer, unless expressly agreed in writing by Bowtex.

Article 4 – Prices

4.1. Unless otherwise stated, all prices are expressed in euros, VAT included.

4.2. Unless otherwise stated, invoices issued by Bowtex are payable on their due date.

4.3. Invoices not paid on their due date will automatically, and without prior notice, incur interest calculated at a rate of 8% per annum.

4.4. Unpaid invoices on their due date will also be subject, by law and without prior notice, to a flat-rate penalty of 10% of the total VAT-inclusive amount of the unpaid invoices, with a minimum of €25.00.

4.5. In case of non-payment of an invoice on its due date, all other invoices become immediately due and payable. Bowtex reserves the right to make further deliveries only if previous invoices have been paid in full.

Article 5 – Modifications

Any changes in transportation rates or any new taxes arising after the conclusion of the contract will result automatically and without prior notice in a corresponding increase in the agreed prices.

Article 6 – Transfer of Risk and Ownership

6.1. The transfer of risk for the goods to the buyer occurs at the time of shipment. In case of damage to the goods during transport, it is the buyer’s responsibility to take any action they deem necessary against the carrier.

6.2. Ownership is transferred to the buyer upon full payment of the price.

Article 7 – Warranty

In accordance with the law of September 1, 2004, concerning the protection of consumers in the sale of consumer goods, Bowtex guarantees the buyer against any lack of conformity that exists at the time of delivery and that appears within two years from that date.

Article 8 – Limitation of Liability

8.1. The products sold by Bowtex have been designed with the utmost care and attention. However, using these products does not exempt the user from wearing legally required equipment. Bowtex products do not guarantee the user's safety in case of falls or accidents of any kind. Bowtex is not liable for any damage resulting from a fall or accident, of any kind, suffered by the user of its products.

8.2. Any claim related to an apparent defect must be reported to Bowtex, by registered mail, within one month of receipt of the goods, and before any modification.

8.3. Any claim concerning a hidden defect must be reported to Bowtex, by registered mail, within one month of discovering the defect.

8.4. Filing a complaint does not exempt the buyer from paying the invoiced amount on the due date.

8.5. Bowtex’s liability is strictly limited to replacing defective goods or refunding the invoiced price. The buyer expressly waives the right to claim any additional compensation of any kind from Bowtex.

Article 9 – Right of Withdrawal and Shipping/Return Conditions

9.1. The buyer has the right to notify the company of their withdrawal from the purchase, without penalties and without providing any reason, within 14 calendar days from the day following the delivery of the product.

9.2. The buyer cannot exercise the right of withdrawal if the product and/or its packaging is no longer in its original condition.

9.3. The buyer must exercise their right of withdrawal within the prescribed period by replying via email to: team@bowtex.store

9.4. The product must be returned within 14 calendar days from the date the customer received the package. It must be returned in its original condition and packaging, including all accompanying documentation. Any return request must be made via email to Bowtex customer service at: team@bowtex.store

9.5. Shipping, Exchanges, and Returns

Shipping costs are automatically calculated at the time of purchase.

All return or exchange requests must go through Bowtex customer service under the conditions stated in section 9.4. Return shipping costs for customers within the European Union are covered by Bowtex. For customers outside the EU, return shipping costs are the buyer’s responsibility.

Article 10 – Force Majeure

10.1. Any case of force majeure or unforeseen circumstance, including those alleged by Bowtex suppliers, entitles Bowtex to suspend all or part of its deliveries.

10.2. Bowtex is entitled to terminate the contract if the force majeure or unforeseen circumstance lasts more than two months. To do so, Bowtex must cancel the contract in writing to the address provided by the buyer in the order.

10.3. Force majeure or unforeseen events include, without being limited to: slowdown or interruption of production, mobilization, strikes, wars, riots, lockouts, administrative restrictions (notably on import/export), transport delays, machine breakdowns, etc.

Article 11 – Intellectual Property

Bowtex holds all intellectual property rights related to the products sold. The name “Bowtex” is a registered Community trademark.

Article 12 – Severability

The annulment or invalidity of any article of these general conditions does not affect the other articles or the validity of the general conditions as a whole.

Article 13 – Competent Courts, Applicable Law

13.1. Only the courts of Brussels, sitting in French, have jurisdiction over any dispute.

13.2. For disputes under the jurisdiction of the justice of the peace, only the peace judge of the Forest canton, sitting in French, is competent.

13.3. Belgian law applies to all disputes.
